Terms of service

These terms govern your use of 8rgolf.com and any purchase you make from Pieces of Eight Golf LLC ("we," "us," "our"). By using the site or placing an order, you agree to them. If you don't agree, please don't use the site.

1. Eligibility

You must be at least 18 years old, or have a parent or guardian's permission, to place an order. You agree that the information you give us is accurate and complete.

2. Products

We describe and photograph our products as accurately as we can. Because our markers are made from natural materials and finished in small batches, each piece may vary slightly from the photos in color, finish, patina or inlay pattern. These variations are not defects.

Product availability is limited and may change without notice. We may discontinue any design at any time.

3. Pricing

Prices are listed in US dollars and may change without notice. A price change won't affect an order we've already confirmed.

If a product is listed at an incorrect price because of a typographical or technical error, we may cancel any orders placed at that price, even after confirmation. If we've charged you, we'll refund you in full.

4. Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, including for suspected fraud, errors in product or pricing information, or limits on quantity. If we cancel an order you've paid for, we'll refund you in full.

We may limit quantities per customer, household, address or payment method, especially for limited releases.

5. Payment

Payment is due when you place your order. Payments are processed by our e-commerce platform and its payment partners. We don't store your full card details. You confirm that you're authorized to use the payment method you provide.

6. Shipping and returns

We ship only to addresses in the United States. Shipping terms are set out in our Shipping Policy, and returns and refunds in our Refund Policy. Both form part of these terms. Title and risk of loss pass to you when we hand your order to the carrier.

7. Custom and personalized orders

For custom work, including event, business and commemorative pieces, you'll approve a design proof before production. Once you approve it, we'll produce the order as shown, and it can't be changed or cancelled. Custom orders are final sale except for manufacturing defects.

If you supply artwork, logos, names or text, you confirm that you own them or have permission to use them, and that they don't infringe anyone else's rights. We may decline any custom request at our discretion, including content we consider offensive or that we believe infringes someone's rights.

8. Limited and numbered releases

Limited and numbered editions are available while supplies last. Edition sizes are stated on the product page. We may cancel orders we believe were placed using automated tools, bots or multiple accounts to get around purchase limits.

9. Intellectual property

All content on this site, including our designs, artwork, logos, the Pieces of Eight Golf name and 8R mark, photos and text, belongs to us or our licensors. You may not copy, reproduce, sell or use it without our written permission. Buying a product doesn't give you any rights to its design.

10. Reviews, comments and photos

If you submit reviews, comments, photos or ideas, you give us a non-exclusive, royalty-free, perpetual license to use, reproduce and display them in connection with our business, including on our site and social media. You confirm that your submission is yours to share and isn't unlawful, misleading or offensive. We may remove any submission at our discretion.

11. Prohibited uses

You agree not to:

Use the site for any unlawful purpose
Interfere with the site's operation or security
Use bots, scrapers or other automated tools to access the site or place orders
Impersonate anyone or give false information
Resell products in a way that misrepresents them as new from us or as authorized by us

12. Disclaimer of warranties

Except as stated in our Refund Policy, the site and our products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products. Our total liability for any claim related to a purchase won't exceed the amount you paid for that purchase.

Some states don't allow certain limitations of liability, so some of these limits may not apply to you.

14. Indemnification

You agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or any artwork or content you provide to us.

15. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. If a dispute arises, please contact us first so we can try to resolve it informally. Any dispute not resolved informally will be heard in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

16. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. Updated terms apply to orders placed after they're posted.

17. General

If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce any part isn't a waiver of it. These terms, together with our policies, are the entire agreement between you and us about your use of the site.
